A RESOLUTION OF THE MIAMI CITY COMMISSION GRANTING OR DENYING THE APPEAL, FILED BY EL PRADO, LLC, OF THE HISTORIC AND ENVIRONMENTAL PRESERVATION BOARD RESOLUTION HEPB-R-26-031 ADOPTED ON MAY 5, 2026, REGARDING INTENDED DECISION BD23-029149-001 FOR THE PROPERTY LOCATED AT 3834 EL PRADO BLVD, MIAMI, FLORIDA.

WHEREAS, the Historic and Environmental Preservation Board (“HEPB”), at its meeting on May 5, 2026, following an advertised public hearing, adopted Resolution No. HEPB-R-26-031 by a vote of four to two (4 \- 2), Item No. 9, recommending approval of the appeal; and
WHEREAS, on March 3, 2026, the City of Miami (“City”) issued Intended DecisionBD23-029149-001 for the removal of One (1) Crape Myrtle, One (1) Gliricidia, One (1) Gumbo Limbo, One (1) Citrus, One (1) Sapodilla, One (1) Frangipani, One (1) Bottlebrush, One (1) Florida Boxwood, One (1) Ylang-Ylang, One (1) Avocado Tree, and Five (5) Palms throughout the property located at 3834 El Prado Blvd., Miami, Florida (the “Property”); and
WHEREAS, the El Prado, LLC (now considered the “Appellant”) proposed to relocate One (1) Specimen Gumbo Limbo, One (1) Hardwood, One (1) Palm throughout the lot, and One (1) Hardwood from the front Right-of-Way (“ROW”) on Utopia Ct. to the Right-of-Way on El Prado Blvd., and One (1) hardwood from the lot to the front ROW; and
WHEREAS, overall, the Appellant, for mitigation purposes, proposed to install Nineteen (19) Hardwood trees measuring 4" DBH x 16' height and Twelve Palms (12) throughout the Property, in addition to, the relocation of One (1) Gumbo Limbo from the front ROW on Utopia Ct. to the ROW on El Prado Blvd., and One (1) Gumbo Limbo from the lot to the front ROW; and
WHEREAS, on March 13, 2026, Walter Ringwald (“Ringwald”), an abutting property owner, filed an appeal of Intended Decision BD23-029149-001 to the Miami Historic and Environmental Preservation Board ("HEPB") pursuant to Section 17-8(a) of the Code of the City of Miami, Florida, as amended (“City Code”); and
WHEREAS, on May 11, 2026, the HEPB held a hearing and adopted Resolution No. HEPB R-26-031 (the “Resolution) granting the appeal filed by Ringwald; and
WHEREAS, on May 20, 2026, the Appellant filed an appeal of the Resolution of the HEPB to the City Commission pursuant to Section 17-8(b) of the City Code alleging that they have adequately complied with the requirements of Article 17 of the City Code, and provided ample mitigation; and
WHEREAS, based on the testimony and evidence presented in the record, and after due notice and an opportunity to be heard has been afforded to all parties and members of the public, the City Commission hereby grants/denies the appeal based on competent substantial evidence, thereby upholding/reversing/modifying Resolution No. HEPB-R-26-031 and upholding/reversing/modifying Intended Decision No. BD23-029149-001;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby grants/denies the appeal, thereby upholding/reversing/modifying the decision of the HEPB as set forth in Resolution No. HEPB-R-26-031 and upholding/reversing/modifying Intended Decision No. BD23-029149-001.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.
