PH.3 - Install Traffic Calming District 2

.WHEREAS, several locations in the City of Miami’s (“City”) District 2 residential neighborhoodsareexperiencingsignificantcut-throughtrafficandspeedingduringrushhour periods; and

WHEREAS,suchcut-throughtrafficandspeedingonlocalresidentialstreetsthatarenot designed for such volume diminishes residents’ quality of life; and

WHEREAS,inadditiontoquality-of-lifeproblemssuchasnoiseandgeneralcongestion, such cut-through traffic and speeding creates significant life-safety risks as residential streets are narrowerthannearby arterialroadways,increasingtherisk ofvehicular accidents,including those involving pedestrians; and

WHEREAS,thosewhocut-throughresidentialneighborhoodsduringrushhourtraffic tend to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and

WHEREAS, inordertoalleviatetheseissues,theCityproposestoinstall eight (8) traffic calming devices at these locations in the residential neighborhoods, as described in Exhibit “A,” attached and incorporated herein, that experience significant cut-through traffic and speeding during morning and afternoon rush hour periods; and

WHEREAS, Section 1.6.a of the Miami-Dade County Traffic Flow Modification(s)/Street Closure(s)Procedure,attached and incorporated herein as Exhibit“B”(“County Procedure”),asrevisedby the Miami-Dade County Department of Transportation and Public Works (“DTPW”) formerly known as theMiami-DadeCountyPublicWorksDepartment(“PWD”) Traffic Engineering Division in January 2009, requires concurrence from the affected residents and/or property owners; and

WHEREAS, Section1.7.coftheCounty Procedurefurtherstates that a municipality“in lieu of concurrence from the affected residents/property owners may elect to have their elected body vote the proposed traffic flow modification(s)/street closure(s) after publichearing and may submit the resolution toDTPW/PWD requesting consideration of the proposed traffic flow modification(s)/street closure(s);" and

WHEREAS, inordertoexpeditiously addresstheaforementionedquality of lifeandlife-safety issues, the City desires to install eight (8) traffic calming devices, as more particularly described in Exhibit "A,” attached and incorporated herein, in designated residential neighborhoodsofDistrict 2withoutdelaybyholdingapublichearinginlieuofresident/property owner concurrence through balloting; and

WHEREAS, althoughtheCity isadoptingthis Resolution after apublic hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residentialpropertieswhosefrontagedirectlyabutstheproposedtrafficcalmingdevices,asare more particularly described in Exhibit "A,” attached and incorporated herein; and

WHEREAS, in lieu of concurrence from the affected residents and/or property owners, theCityCommissionfinds it inthebestinterestoftheCityanditsresidentstopassaresolution after a public hearing requesting DTPW/PWD to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "A,” attached and incorporated herein;

NOW,THEREFORE,BEITRESOLVEDBYTHECOMMISSIONOFTHECITYOF MIAMI, FLORIDA:

Section1.TherecitalsandfindingscontainedinthePreambletothisResolutionare adopted by reference and incorporated as fully set forth in this Section.

Section 2. The City Commission, after a duly noticed public hearing, authorizes and directs the City Manager to take all actions necessary to expeditiously request that DTPW/PWD considertheproposedtrafficflowmodificationatthefollowing eight (8)locationswithin District 2,asmoreparticularly described inExhibit“A”,attachedand incorporated herein, in orderto expeditiously proceed with design and construction of the traffic calming devices:

1.Crawford Avenue between Kent Court and Kent Road

2.Poinciana Avenue between La Playa Boulevard and Braganza Avenue

3.El Prado Boulevard between Le Jeune Road and La Playa Boulevard

4.Malaga Avenue between Le Jeune Road and La Playa Boulevard

5.Barbarossa Avenue between Southwest 42ndAvenue and Braganza Avenue

6.Woodridge Road between Southwest 42ndAvenue and Brighton Place

7.Battersea Road between Ingraham Highway and Douglas Road

8.Elizabeth Street between Bird Avenue and Shipping Avenue

Section3.TheCityClerkisdirectedtosendacertifiedcopyofthisResolutiontothe Director of Miami-Dade County’s Department of Transportation and Public Works.

Section4.ThisResolutionshallbecomeeffectiveimmediatelyuponitsadoption.
