A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AFTER A DULY NOTICED PUBLIC HEARING, AUTHORIZING AND DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTION(S) NECESSARY TO EXPEDITIOUSLY REQUEST THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS (“DTPW”) TO CONSIDER THE PROPOSED TRAFFIC FLOW MODIFICATIONS AND WAIVE THE REQUIRED RESIDENT CONCURRENCE AND EXEMPT THE BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF TRAFFIC CALMING DEVICES AT THIRTY-SIX (36) LOCATIONS IN THE RESIDENTIAL NEIGHBORHOODS OF DISTRICT 4, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT “A,” ATTACHED AND INCORPORATED; DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE DTPW DIRECTOR.

WHEREAS, several locations in the City of Miami’s (“City”) District 4 residential neighborhoodsareexperiencingsignificantcut-throughtrafficandspeedingduringrushhour periods; and

WHEREAS,suchcut-throughtrafficandspeedingonlocalresidentialstreetsthatarenot designed for such volume diminishes residents’ quality of life; and

WHEREAS,inadditiontoquality-of-lifeproblemssuchasnoiseandgeneralcongestion, such cut-through traffic and speeding creates significant life-safety risks as residential streets are narrowerthannearby arterialroadways,increasingtherisk ofvehicular accidents,including those involving pedestrians; and

WHEREAS,thosewhocut-throughresidentialneighborhoodsduringrushhourtraffic tend to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and

WHEREAS, inordertoalleviatetheseissues,theCityproposestoinstall thirty-six (36) traffic calming devices at these locations in the residential neighborhoods, as described in Exhibit “A,” attached and incorporated herein, that experience significant cut-through traffic and speeding during morning and afternoon rush hour periods; and

WHEREAS, Section 1.6.a of the Miami-Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, attached and incorporated herein as Exhibit “B” (“County Procedure”), as revised by the Miami-Dade County Department of Transportation and Public Works (“DTPW”) formerly known as the Miami-Dade County Public Works Department (“PWD”) Traffic Engineering Division in January 2009, requires concurrence from the affected residents and/or property owners; and

WHEREAS, Section 1.7.c of the County Procedure further states that a municipality “in lieu of concurrence from the affected residents/property owners may elect to have their elected body vote the proposed traffic flow modification(s)/street closure(s) after public hearing and may submit the resolution to DTPW/PWD requesting consideration of the proposed traffic flow modification(s)/street closure(s);" and

WHEREAS, inordertoexpeditiously addresstheaforementionedquality of lifeandlife-safety issues, the City desires to install thirty-six (36) traffic calming devices, as more particularly described in Exhibit "A,” attached and incorporated herein, in designated residential neighborhoodsofDistrict 4withoutdelaybyholdingapublichearinginlieuofresident/property owner concurrence through balloting; and

WHEREAS, althoughtheCity isadoptingthis Resolution after apublic hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residentialpropertieswhosefrontagedirectlyabutstheproposedtrafficcalmingdevices,asare more particularly described in Exhibit "A,” attached and incorporated herein; and

WHEREAS, in lieu of concurrence from the affected residents and/or property owners, theCityCommissionfinds it inthebestinterestoftheCityanditsresidentstopassaresolution after a public hearing requesting DTPW/PWD to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "A,” attached and incorporated herein;

NOW,THEREFORE,BEITRESOLVEDBYTHECOMMISSIONOFTHECITYOF MIAMI, FLORIDA:

Section1.TherecitalsandfindingscontainedinthePreambletothisResolutionare adopted by reference and incorporated as fully set forth in this Section.

Section 2. The City Commission, after a duly noticed public hearing, authorizes and directs the City Manager to take all actions necessary to expeditiously request that DTPW/PWD considertheproposedtrafficflowmodificationatthefollowing thirty-six (36)locationswithin District 4,asmoreparticularly described inExhibit“A,”attachedand incorporated herein, in orderto expeditiously proceed with design and construction of the traffic calming devices:

1\. Southwest Twelfth Street between Southwest Twenty-Second Avenue and Southwest Twenty-Third Avenue

2\. Southwest Twelfth Street between Southwest Twenty-Third Avenue and Southwest Twenty-Fourth Avenue

3\. Southwest Thirteenth Street between Southwest Twenty-Third Court and Southwest Twenty-Third Avenue

4\. Southwest Thirteenth Street between Southwest Twenty-Fifth Avenue and Southwest Twenty-Seventh Avenue

5\. Southwest Sixth Street between Southwest Twenty-Second Avenue and Southwest Twenty-Third Avenue

6\. Southwest Sixth Street between Southwest Twenty-Third Avenue and Southwest Twenty-Fourth Avenue

7\. Southwest Sixth Street between Southwest Twenty-Fourth Avenue and Southwest Twenty-Fifth Avenue
