A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT AN ACCESS EASEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FROM ACRE GCDM INVESTMENT, A DELAWARE LIMITED LIABILITY COMPANY REGISTERED TO DO BUSINESS IN FLORIDA, AND MIMO BAY APARTMENTS II, LLC, A DELAWARE LIMITED LIABILITY COMPANY REGISTERED TO DO BUSINESS IN FLORIDA, FOR THE INGRESS AND EGRESS OF EMERGENCY VEHICLES OVER AND UPON THE PROPERTY LOCATED AT 6445 NORTHEAST 7 AVENUE, MIAMI, FLORIDA 33130.

WHEREAS,MIMO Bay Apartments II LLC,aDelawareLimitedLiabilityCompany registered to do business in Florida (โBeneficiaryโ), is a beneficiary of the referenced ingress and access easement and is the fee simple owner of the benefitted properties, which are adjacent to the Affected Property; and
WHEREAS, the City of Miami (โCityโ) desires to assure emergency vehicle ingress and egress accesstothe Beneficiary from the Affected Property andtheGrantorofferedtograntanaccesseasementto the City for emergency vehicle ingress and egress (โAccess Easementโ) over a portion of the Affected Property, as more particularly described in Exhibit โA,โ attached and incorporated; and
WHEREAS, thepurposeoftheAccessEasementistoensurethatemergency vehicleswill have ingress and egress access, including turn-around access, within the easement area; and
WHEREAS, Beneficiary is in the process of finalizing a plat of the benefitted properties adjacent to the Affected Property and the Access Easement is required to complete the platting process; and
WHEREAS,theGrantorand Beneficiary will maintainandassumeliabilityresponsibilityfor the Access Easement located on the Affected Property; and
WHEREAS,theCityagreeswiththetermsandconditionsintheAccessEasement, in a form acceptable to the City Attorney, and as referenced herein;
NOW,THEREFORE,BEITRESOLVEDBYTHECOMMISSIONOFTHECITYOF MIAMI, FLORIDA:
Section1.TherecitalsandfindingscontainedinthePreambletothisResolutionare adopted by reference and incorporated as if fully set forth in this Section.
Section 2.The City Manager is authorized to accept the Access Easement for the Affected Property,ina form acceptable to the City Attorney, from the Grantor and Beneficiary.
Section 3.TheCityManager isfurther authorized1 to negotiate and execute any andall othernecessarydocuments relatedtotheAccessEasement,inaformacceptabletotheCity Attorney.
Section4.TheCityManagerisfurtherauthorized1torecordsaidinstrumentinthe Public Records of Miami-Dade County, Florida.
Section5.ThisResolutionshallbecomeeffectiveimmediatelyuponitsadoption.
