A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE, AND APPROPRIATE FUNDS FROM THE DEPARTMENT OF ENVIRONMENTAL PROTECTION'S RESILIENT FLORIDA PROGRAM FISCAL YEAR 2025-2026 IN AN AMOUNT NOT TO EXCEED FIVE MILLION, NINE HUNDRED SEVENTY THOUSAND, SEVEN HUNDRED EIGHTEEN AND 00/100 DOLLARS ($5,970,718.00) (“GRANT FUNDS”) AS SPECIFIED IN EXHIBIT “A," ATTACHED AND INCORPORATED, FOR THE EAST FLAGAMI FLOOD IMPROVEMENTS PROJECT 40-B223801 (“PURPOSE”) WITH A REQUIRED LOCAL MATCH IN AN AMOUNT NOT TO EXCEED FIVE MILLION, NINE HUNDRED SEVENTY THOUSAND, SEVEN HUNDRED EIGHTEEN AND 00/100 DOLLARS ($5,970,718.00), FROM PREVIOUSLY BUDGETED FUNDS, INCLUDING MIAMI FOREVER BOND FUNDS, IN CAPITAL PROJECT NO. 40-B223801; APPROPRIATING THE GRANT FUNDS FOR THE PURPOSE STATED HEREIN; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICA...

WHEREAS,FDEPhasawardedtheCitythe2025-2026grantawardforanamountnottoexceedFive Million, Nine Hundred Seventy Thousand, Seven Hundred Eighteen and00100 Dollars($5,970,718.00)(“GrantFunds”);and
WHEREAS, the Grant requires matching funds from the City in the amount of Five Million, Nine Hundred Seventy Thousand, Seven Hundred Eighteen and 00100 Dollars ($5,970,718.00), from previously budgeted funds in capital project No. 40-B223801, which said previously budgeted funds includes Miami Forever Bond funds; and
WHEREAS, theGrantFundswillhelpwithwaterquality improvement activitiesandlow-lyingareasthatfrequentlyfloodduetooverwhelmedstormwatersystemsduringheavyrainand storm surges in the South Florida coastal community; and
WHEREAS, the City wishes to accept, budget, allocate, and appropriate the Grant FundsfromFDEPasspecifiedinExhibit “A,”attachedandincorporated;and
WHEREAS, it is appropriate for the City Commission to authorize the City Manager to accept, budget, allocate, and appropriate the Grant Funds, and to negotiate and execute any and all necessary documents, including but not limitedto,amendments,extensions,renewals,andmodifications,allinformsacceptabletothe CityAttorney,fortheacceptance,administrationandimplementationof,andcompliancewithall applicable laws, rules, and regulations, for said purpose;
NOW,THEREFORE,BEITRESOLVEDBYTHECOMMISSIONOFTHECITYOF MIAMI, FLORIDA:
Section1.TherecitalsandfindingscontainedinthePreambletothisResolutionare adopted by reference and incorporated as if fully set forth in this Section.
Section2.TheCityManagerisherebyauthorized toaccept,budget,allocate,and appropriate the Grant Funds to be utilized for the purposes stated herein.
Section3.TheCapitalFundProjectNumber40-B223801 isestablished,andtheGrantFundsareappropriatedasdescribedinExhibit “A,"attachedandincorporated.
Section 4.The City Manager is authorized1 to negotiate and execute any and all necessarydocuments,includingbutnotlimitedto,amendments,extensions,renewals,and modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds, administration, implementation, and compliance with all applicable laws, rules, and regulations, for said purpose.
Section 5. The allocation and appropriation of the funds referenced herein are subject to all federal, State, and local laws that regulate the use of such funds and the receipt of all necessary approvals, including, but not limited to the City Attorney.
Section 6. The City Manager is authorized1to make any changes to adjust, amend, and appropriate the City’s Operating Budget, Five-Year Financial Plan, Strategic Plan, Multi-Year Capital Plan, and any other documents as necessary and applicable, pursuant to the provisions of this Resolution.
Section 7. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the Capital Plan, relevant financial controls and computer systems in connection therewith, for project close-outs, and for grants and other funding sources in progress in connection herewith are ratified, approved, and confirmed.
Section8.ThisResolutionshallbecomeeffectiveimmediatelyuponitsadoptionand signature of the Mayor.
