WHEREAS, the City of Miami (“City”) has a continuing need for pest control services at various City facilities, including monthly pest control services and additional pest control services on an as-needed basis (“Services”); and
WHEREAS, on April 22, 2026, the Department of Procurement (“Procurement”) issued Invitation for Bid (“IFB”) No. 2017387 (“Solicitation”) under full and open competition for the Services, for an initial contract term of three (3) years with the option to renew for two (2) additional two (2) year periods; and
WHEREAS, the Solicitation provides that Groups 1 through 9, Citywide Monthly Pest Control Services, will be awarded to the lowest responsive and responsible bidder offering the lowest aggregate price for all groups and items, and that Group 10, Additional Citywide Pest Control Services, will be awarded to all responsive and responsible bidders meeting the minimum requirements, which will be placed in a pre-qualified pool of vendors from which the City will obtain spot market quotations on an as-needed basis; and
WHEREAS, on May 29, 2026, Procurement received six (6) bids in response to the Solicitation, which were evaluated and tabulated in accordance with the Solicitation, and the bid submitted by Terminix was deemed non-responsive for failure to submit the certification of all personnel responsible for applying pesticides required by the minimum qualifications of the Solicitation; and
WHEREAS, after review and tabulation of the remaining bids, Tower Pest Control, Inc., a Florida for-profit corporation (“Tower”), was determined to be the lowest responsive and responsible bidder for Groups 1 through 9, and Tower, Southern Service Solutions, LLC, ReliaPro Pest Control, LLC, Power Exterminators, Inc., and Mack Pest Control LLC (collectively, “Pool Contractors,” and together with Tower, “Contractors”) were determined to be responsive and responsible bidders meeting all requirements for Group 10; and
WHEREAS, the City Manager recommended award of Groups 1 through 9 to Tower in an estimated annual amount of Twenty-Six Thousand, Ninety-Four and 00/100 Dollars ($26,094.00), and award of Group 10 to the Pool Contractors on an as-needed basis, as further specified in the recommendation memorandum attached and incorporated as Exhibit “A” (“City Manager’s Recommendation”); and
WHEREAS, Section 18-85 of the Code of the City of Miami, Florida, as amended (“City Code”), provides the procedures for competitive sealed bidding, including that bid awards in excess of $50,000.00 must be approved by the City Commission upon recommendation by the City Manager; and
WHEREAS, the City Commission desires to approve the bid awards to the Contractors and authorize the City Manager to negotiate and execute contracts and any necessary amendments, renewals, and extensions, all in forms acceptable to the City Attorney and consistent with the terms stated herein, for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 18-85 of the City Code, the City Manager’s Recommendation is approved, and the bid awards pursuant to the Solicitation to Tower for Groups 1 through 9, in an estimated annual amount of Twenty-Six Thousand, Ninety-Four and 00/100 Dollars ($26,094.00), and to the Pool Contractors for Group 10, to establish a pre-qualified pool of vendors for additional citywide pest control services on an as-needed basis through spot market quotations, each for an initial contract term of three (3) years with the option to renew for two (2) additional two (2) year periods, are hereby approved.
Section 3. Funds for this purpose shall be allocated from the various user departments and agencies’ departmental funds, subject to the availability of funds and budgetary approval at the time of need.
Section 4. The City Manager is authorized to negotiate and execute contracts, in forms acceptable to the City Attorney, with the Contractors for the Services consistent with the terms set forth herein.
Section 5. The City Manager is further authorized1 to negotiate and execute any documents, including amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to all allocations, appropriations, and prior budgetary approvals, and in compliance with applicable provisions of the City Code, including the City of Miami’s Procurement Ordinance, Anti-Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, and all applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption.
