RE.13 - A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO COMPLETE A COMPREHENSIVE MARKET STUDY REGARDING THE CITY OF MIAMI’S ("CITY") TROLLEY SERVICES BEFORE SELECTING A PROCUREMENT METHOD FOR FUTURE TROLLEY SERVICES; DIRECTING THE CITY MANAGER, IN CONSULTATION WITH THE CHIEF PROCUREMENT OFFICER, TO PURSUE THE PROCUREMENT METHOD DETERMINED TO BE IN THE BEST INTEREST OF THE CITY, INCLUDING A COMPETITIVE SOLICITATION OR OTHER VALID PROCUREMENT METHOD AUTHORIZED BY LAW; PROVIDING THAT ANY RESULTING PROCUREMENT SHALL, UNLESS THE CITY MANAGER DETERMINES OTHERWISE IN THE CITY’S BEST INTEREST, REQUIRE THE AWARDED ENTITY TO OPERATE THE TROLLEY SERVICES AND ACQUIRE, LEASE, OR OTHERWISE PROVIDE, MAINTAIN, AND REPAIR THE TROLLEYS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE DOCUMENTS NECESSARY FOR SAID PURPOSE, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO LEGALLY AVAILABLE FUNDS, BUDGETARY APPROVAL, AND APPLICABLE LAW; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the City of Miami (“City”) provides trolley services for the benefit of City residents, visitors, and businesses and currently contracts for the operation of those services; and
WHEREAS, the City Commission recognizes the need to evaluate future trolley service options in light of current operations, fleet needs, service levels, costs, and anticipated growth; and
WHEREAS, the City Commission further recognizes that future trolley service planning should consider available procurement options and the potential allocation of operational, fleet acquisition, maintenance, and repair responsibilities;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is directed to conduct a comprehensive market study regarding the City’s trolley services before selecting a procurement method for future trolley services.
Section 3. The market study must evaluate, at a minimum, the City’s current trolley fleet, existing operational costs, current service levels, and projected service and fleet needs resulting from anticipated growth.
Section 4. Following completion of the market study, the City Manager shall present the market study findings and recommended procurement method to the City Commission before proceeding with the selected procurement method, unless further City Commission approval is otherwise required by law or the City Code.
Section 5. The City Manager, in consultation with the Chief Procurement Officer, is directed to pursue the procurement method determined to be in the City’s best interest, including a competitive solicitation or other valid procurement method authorized by applicable law and the City Code.
Section 6. Any resulting procurement shall, unless the City Manager determines otherwise in the City’s best interest, require the awarded entity to operate the City’s trolley services and acquire, lease, or otherwise provide, maintain, and repair the trolleys.
Section 7. The City Manager is authorized to negotiate and execute all documents necessary for said purpose, including agreements, amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to legally available funds, budgetary approval, and compliance with applicable law and the City Code, including the City’s Procurement Ordinance, Anti-Deficiency Act, and Financial Integrity Principles, as set forth in Chapter 18 of the City Code.
Section 8. This Resolution shall become effective immediately upon its adoption.
