WHEREAS, the City of Miami (“City”) requires Job Order Contracting (“JOC”) Services for Horizontal, Vertical, Marine/Seawall, and Roofing Construction (“Services”) contracts on an as-needed basis for Citywide federally and non-federally funded projects; and
WHEREAS, on September 3, 2025, the Department of Procurement (“Procurement”) issued Request for Proposals (“RFP”) No. 24-25-002 to establish contracts for the Services; and
WHEREAS, on October 21, 2025, Procurement received twenty-one (21) proposals in response to the RFP, of which one (1) proposal from H & J Asphalt, Inc. was initially found non-responsive and one (1) proposal from Apollo Construction & Engineering Services, Inc. was found non-responsive to one (1) category; and
WHEREAS, on February 5, 2026, the Evaluation Committee (“Committee”), appointed by the City Manager, convened to complete the Step 1 evaluation and, upon completion of the scoring session, exercised its discretion to waive Step 2 proceedings; and
WHEREAS, upon request by H & J Asphalt, Inc., and in consultation with the Office of the City Attorney, Procurement reviewed clarification statements included in H & J Asphalt, Inc.’s proposal and determined that H & J Asphalt, Inc. met the minimum qualifications and experience requirements of the RFP; and
WHEREAS, on May 14, 2026, the Committee convened to complete the Step 1 evaluation of H & J Asphalt, Inc.’s proposal and, upon completion of the scoring session, exercised its discretion to waive Step 2 proceedings; and
WHEREAS, negotiations failed with Apollo Construction & Engineering Services, Inc. and Ric-Man International, Inc. because Apollo Construction & Engineering Services, Inc. did not respond to the City’s offer after multiple attempts to contact it and Ric-Man International, Inc. declined the City’s counter-proposed adjustment factors; and
WHEREAS, successful negotiations were held between June 16, 2026, and July 6, 2026, with the remaining nineteen (19) proposers; however, due to a pending claim with the City, a contract will not be awarded to LEE Construction Group, Inc. unless and until such claim is resolved; and
WHEREAS, the City Manager recommended award of contracts for the Services to A & J Roofing Corp., Advanced Roofing, Inc., Apex Roofing USA, LLC (f/k/a Atlas Apex Roofing, LLC), Avila Construction & Glazing Inc., David Mancini & Sons, Inc., Dekora, LLC, Epic Consultants, Inc., F.H. Paschen, S.N. Nielsen & Associates LLC, Florida Engineering and Development Corp., H & J Asphalt, Inc., H. A. Contracting Corp., Harbour Construction, Inc., Kearns Construction Company, Salomon Construction and Roofing Corp., S-Works Construction Corporation, Team Contracting, Inc., Terra Hyle Contractors, Inc., and Unitech Builders Corp. (“Contractors”), for an initial term of three (3) years with the option to renew for two (2) additional one (1) year periods, as further specified in the recommendation attached and incorporated as Exhibit “A” (“City Manager’s Award Recommendation”); and
WHEREAS, each contract shall have an annual not to exceed contract amount of Five Million and 00/100Dollars ($5,000,000.00) per contract, with rates based on the Gordian Construction Task Catalog multiplied by each respective Contractor’s adjustment factor as set forth in Exhibit “B,” subject to availability of funds and budgetary approval at the time of need; and
WHEREAS, Section 18-86 of the Code of the City of Miami, Florida, as amended (“City Code”), provides the procedures for use of competitive sealed proposals, including that awards in excess of $50,000.00 must be approved by the City Commission upon recommendation by the City Manager; and
WHEREAS, the City Commission desires to approve the City Manager’s Recommendation and to authorize the City Manager to negotiate and execute contracts with each Contractor for the Services, and any necessary amendments, renewals, extensions, and related documents, all in forms acceptable to the City Attorney and consistent with the terms herein stated, for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 18-86 of the City Code, the City Manager’s Award Recommendation for the RFP for the provision of JOC Services for Horizontal, Vertical, Marine/Seawall, and Roofing Construction (“Services”) contracts on an as-needed basis for Citywide federally and non-federally funded projects, for an initial term of three (3) years with the option to renew for two (2) additional one (1) year periods, to A & J Roofing Corp., Advanced Roofing, Inc., Apex Roofing USA, LLC (f/k/a Atlas Apex Roofing, LLC), Avila Construction & Glazing Inc., David Mancini & Sons, Inc., Dekora, LLC, Epic Consultants, Inc., F.H. Paschen, S.N. Nielsen & Associates LLC, Florida Engineering and Development Corp., H & J Asphalt, Inc., H. A. Contracting Corp., Harbour Construction, Inc., Kearns Construction Company, Salomon Construction and Roofing Corp., S-Works Construction Corporation, Team Contracting, Inc., Terra Hyle Contractors, Inc., and Unitech Builders Corp. (“Contractors”), with an annual not to exceed contract amount of Five Million and 00/100Dollars ($5,000,000.00) per contract, with rates based on the Gordian Construction Task Catalog multiplied by each respective Contractor’s adjustment factor as set forth in Exhibit “B,” is approved subject to availability of funds and budgetary approval at the time of need.
Section 3. Funds for this purpose shall be allocated from the applicable end-user department, capital project, grant, bond, or other legally available funding sources, subject to the availability of funds and budgetary approval at the time of need.
Section 4. The City Manager is authorized to negotiate and execute contracts, all in forms acceptable to the City Attorney, with each Contractor for the Services consistent with the terms herein.
Section 5. The City Manager is further authorized1 to negotiate and execute all other documents, including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to all allocations, appropriations, prior budgetary approvals, and compliance with applicable provisions of the City Code, including the City of Miami’s Procurement Ordinance, Anti-deficiency Act, and financial integrity principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption.
