RE.6 - A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ESTABLISH A TRAFFIC CONTROL DETAIL WITHIN THE CITY OF MIAMI (“CITY”) POLICE DEPARTMENT’S TRAFFIC UNIT (“MTCU”) TO DIRECT TRAFFIC AT FIXED POSTS AT THE CITY'S MOST CONGESTED LOCATIONS TO EXPEDITE THE SAFE MOVEMENT OF PEDESTRIANS IN THEIR ASSIGNED POST AND MINIMIZE TRAFFIC FLOW DELAYS; FURTHER AUTHORIZING THE CITY MANAGER TO PROVIDE FOR SAID DETAIL IN THE FISCAL YEAR 2026-2027 OPERATING BUDGET, FIVE-YEAR FINANCIAL PLAN, STRATEGIC PLAN, AND MULTI-YEAR CAPITAL PLAN REGARDING CITY SERVICES AND RESOURCES AS NECESSARY, LEGALLY ALLOWED, AND APPLICABLE IN ORDER TO AUDIT AND CREATE SAID POSITIONS FOR THE DEPARTMENT; RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS OF THE CITY MANAGER AND DESIGNATED CITY DEPARTMENTS TO UPDATE THE RELEVANT FINANCIAL CONTROLS, PROJECT CLOSE-OUTS, ACCOUNTING ENTRIES, AND COMPUTER SYSTEMS; PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.

WHEREAS, the City of Miami (“City”) is responsible for public safety throughout the City, which includes pedestrian and motor vehicle initiatives to increase safety, traffic flow, and prevent crashes resulting in injuries; and
WHEREAS, the City seeks to provide additional resources to the City’s Police Department (“MPD”) to create a pathway for developing and implementing effective localized, high visibility traffic control operations in areas within the City with the highest occurrences of traffic congestion to improve traffic conditions and prevent injuries to pedestrians and bicyclists; and
WHEREAS, pursuant to Section 316.640(4), Florida Statutes, a municipality may employ as a “traffic control officer” any individual who successfully completes at least eight (8) hours of instruction in traffic control procedures through a program approved by the Division of Criminal Justice Standards and Training of the Department of Law Enforcement, or through a similar program offered by the local police department, but who does not necessarily otherwise meet the uniform minimum standards established by the Criminal Justice Standards and Training Commission for law enforcement officers or auxiliary law enforcement officers under Section 943.13, Florida Statutes; and
WHEREAS, traffic control officers are authorized to direct traffic or operate a traffic control device at a fixed location and only upon the direction of a fully qualified law enforcement officer; and
WHEREAS, it is the desire of the Miami City Commission to establish a Miami Traffic Control Detail (“MTCD”)within MPD’s Traffic Unit(“MTCU”), made up of at least eight (8) traffic control officers as provided inSection 316.640(4), Florida Statutes,and can be augmented by other MPD personnel when said traffic control officers positions are vacant; and
WHEREAS, said traffic control officers or MPD personnel must be supervised by sworn MPD commander and assigned to direct traffic at the City's most congested locations to ensure the safe movement of pedestrians while improving vehicular traffic conditions on streets and intersections during peak or high traffic periods; and
WHEREAS, upon approval of this Resolution, MPD shall establish standard operating procedures providing for the MTCD’s purpose, scope, and deployment objectives consistent with the intent of this legislation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized and directed to establish a traffic control detail within the MTCU to direct traffic at fixed posts at the City's most congested locations to expedite the safe movement of pedestrians in their assigned post and minimize traffic flow delays.
Section 3. The City Manager is further authorized1 to provide for said detail in the Fiscal Year 2026-2027 operating budget, five-year financial plan, strategic plan, and multi-year capital plan regarding city services and resources as necessary, legally allowed, and applicable.
Section 4. The City Manager and the designated City departments are authorized1 to update the relevant financial controls, project close-outs, accounting entries, and computer systems and said updates are hereby ratified, approved, and confirmed.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.
